LexisNexis® Releases PTAB Argument Finder, New Tool to Help Patent Attorneys Surface Winning Arguments in USPTO Appeals
New search feature in LexisNexis PatentAdvisor® gives patent professionals quick access to specific arguments that have prevailed in previous PTAB decisions.
NEW YORK, July 6, 2022 — LexisNexis® Legal & Professional, a leading global provider of information and analytics, today announced the introduction of PTAB Argument Finder, an innovative search tool for users of its PatentAdvisor™ solution that enables patent attorneys to quickly locate winning arguments in appeals decided by the Patent Trial and Appeal Board (PTAB).
“The ability to locate targeted winning arguments to use in USPTO office action responses and PTAB appeal briefs can be a game-changer for patent attorneys, especially when the stakes in this venue are so high,” said Andrew Matuch, president of LexisNexis ReedTech and Intellectual Property Solutions. “In a recent survey of patent prosecutors relying on examiner statistics, 83% told us that a PTAB Argument Finder tool would be very helpful, so we built it for them.”
The PTAB is a tribunal within the United States Patent and Trademark Office (USPTO) that reviews rejections made by examiners in proceedings called ex parte appeals and decides patentability questions for issued patents raised by third parties in other litigation proceedings. Last year, there were 7,877 final decisions made by the PTAB, making it the most active forum for patent disputes nationwide, and those decisions were affirmed by federal courts in three of four cases.
PTAB Argument Finder is an intuitive search feature that empowers patent attorneys to identify winning arguments more easily, reduce the amount of time spent preparing PTAB appeals, improve patent prosecution outcomes, and obtain new clients by showcasing their proven track record with PTAB appeals.
“We identified 217 specific legal issues embedded within the thousands of ex parte appeal decisions issued by the PTAB, then developed a search tool that enables patent professionals to surface the relevant arguments that prevailed in similar cases,” said Matuch. “This intelligence can be used to strengthen a response to an office action and make winning arguments on appeal.”
Within PatentAdvisor, users simply go to the PTAB Decisions section that allows them to locate relevant issues from within more than 111,000 PTAB decision documents indexed since 2007. They select the search parameters that match up with their specific case by using common issue tags, run their search, click on the case decisions that pop up, and scroll down to review the relevant highlighted arguments.
Most of the time, attorneys will either search for a sub-issue and view those cases, or limit by a specific examiner to gauge how those previous PTAB cases were decided. After selecting a case of interest, they can easily locate the highlighted arguments using Argument Finder, or jump straight to the case conclusion.
